The parents of a four-year-old girl who was raped in a McDonald’s toilet are taking legal action against her school.
The child was on a school trip in Oklahoma, US, when the attack is said to have taken place on July 16.
Oklahoma News 4 reports the girl was subjected to a sickening assault in the fast food restaurant’s Playplace toilets.
Police said 37-year-old Joshua Kabatra was arrested at the scene and he later admitted he’d raped the youngster after she went to the bathroom unsupervised.
The assault took place in a Midwest City McDonald’s and now the child’s family is taking a metropolitan Christian school to court.
The news channel said the lawsuit blames the caretakers watching over the girl and others while they on the field trip.
The legal document says the girl was there with her daycare from her Christian school.
It alleges the daycare “recklessly and negligently allowed the victim to be injured”.
After five minutes, two daycare staff realised she had “been gone for a while” and knocked on the door.
He opened up with his hands up saying: “I was just washing my hands.”
Police told the news channel Kabatra later admitted molesting the girl.
In the days after the attack, Midwest City Police Chief Brandon Clabes told the TV station: “There is no fault on the daycare workers.
“They were doing their job. They just realised the child had been missing longer than a child should be at that age.”
But the lawsuit disputes this, and seeks compensation for damages including medical bills, pain and suffering, and emotional distress.
